Welcome to ND Real Estate. By accessing or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before engaging with our property services.

Throughout these terms, "Company", "We", "Us", or "Our" refers to NIK DHIMAL LTD. "You" or "Client" refers to the individual or entity using our services.

2. Services Overview

ND Real Estate provides the following professional property services in London, United Kingdom:

  • Property Investment Consultation: Expert guidance on property investment opportunities, market analysis, and ROI projections.
  • House Finding Services: Comprehensive property sourcing and viewing arrangements tailored to your requirements and budget.
  • Guaranteed Rent Service: Long-term rental income protection with direct property management (detailed in Section 3).
  • Property Management: Full-service property management including tenant placement, maintenance coordination, and rent collection.
  • Mortgage & Solicitor Introductions: Professional connections to trusted mortgage brokers and legal advisors.

All services are provided subject to availability, qualification criteria, and mutual agreement on terms.

3. Guaranteed Rent Service - Specific Terms

3.1 Service Description

Our Guaranteed Rent Service provides landlords with fixed monthly rental income for a minimum contract period of 3 years. ND Real Estate becomes the direct tenant and assumes all responsibilities for finding and managing sub-tenants.

3.2 What You Receive

  • Guaranteed Monthly Income: Fixed rent paid to you on the same date every month for the entire contract duration, regardless of property occupancy status.
  • Payment from Day 1: Your guaranteed rent begins from the contract start date, with no waiting periods or void period gaps.
  • Void Period Protection: You receive full payment even if the property is empty or between tenants.
  • Late Payment Protection: You get paid on time even if our sub-tenant pays late or fails to pay.
  • Zero Legal Costs: We cover 100% of eviction costs, court fees, and legal proceedings while continuing your rent payments.
  • No Tenant Contact: You deal exclusively with ND Real Estate. All tenant queries, complaints, and issues are handled by us.
  • Property Maintenance: We coordinate all property inspections and maintenance management.
  • Internal Condition Guarantee: Property condition protected up to 1.5 months' rent, subject to fair wear and tear exclusions.
  • Property Return Guarantee: Property returned in the same condition as received (subject to fair wear and tear).
  • 90-Day Exit Option: If you are not satisfied with our service, you may terminate the agreement with 90 days' written notice.

3.3 Landlord Responsibilities

  • Provide a property that meets all legal safety requirements (Gas Safety Certificate, EPC, EICR, etc.)
  • Maintain the property's structural integrity and external condition
  • Ensure all statutory compliance throughout the contract period
  • Allow reasonable access for property inspections (with proper notice)
  • Maintain buildings insurance for the property

3.4 Management Fee & Payment Terms

Our management fee is 5% of the guaranteed monthly rent (exclusive limited-time offer, subject to availability). This fee covers all management services, tenant sourcing, vetting, placement, and ongoing property administration.

No Hidden Costs: There are no setup fees, tenant find fees, monthly commissions, renewal fees, or other hidden charges beyond the agreed management percentage.

3.5 Contract Duration & Termination

The minimum contract period is 3 years. The agreement may be extended by mutual consent. Early termination by the landlord requires 90 days' written notice and may be subject to reasonable compensation for our lost rental income during the notice period.

3.6 Fair Wear & Tear Definition

Fair wear and tear includes reasonable deterioration from normal residential use over time (e.g., minor scuffs, carpet wear from foot traffic, paint fading). It does not include damage from negligence, misuse, or failure to maintain the property (e.g., broken fixtures, holes in walls, permanent stains, structural damage).

4. House Finding Service Terms

4.1 Service Packages

We offer three house finding service tiers: Silver, Gold, and Diamond. Each package includes different levels of support, property sourcing, and additional services as detailed on our website.

4.2 Payment & Refunds

House finding fees are payable upfront upon contract signing. If we fail to find a suitable property within 3 months of engagement, we will refund your service fee in full and provide an additional £1,000 compensation for the inconvenience.

4.3 Property Criteria

You must provide clear property requirements including location, budget, property type, and any specific needs. We will source properties matching your criteria, but final purchase decisions rest solely with you.

5. General Terms of Use

5.1 Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use our services.

5.2 Accurate Information

You agree to provide accurate, complete, and current information when engaging our services. Misrepresentation may result in service termination without refund.

5.3 Professional Advice

Our services include property market guidance and investment insights. However, we are not financial advisors, and you should seek independent financial, tax, and legal advice before making property investment decisions.

6. Limitation of Liability

To the maximum extent permitted by law:

  • ND Real Estate is not liable for property market fluctuations, changes in property values, or investment outcomes.
  • Our total liability for any claims arising from our services shall not exceed the total fees paid by you in the preceding 12 months.
  • We are not liable for indirect, consequential, or incidental damages including lost profits, lost rental income (outside guaranteed rent agreements), or business interruption.
  • For Guaranteed Rent Service clients, our liability is limited to fulfilling our contractual obligation to pay your guaranteed rent as agreed.

Property Investment Risk: Property investment carries inherent risks. Past performance does not guarantee future results. You acknowledge that property values can decrease as well as increase.

7. Data Protection & Privacy

We collect and process personal data in accordance with UK GDPR and Data Protection Act 2018. Your data is used solely for:

  • Providing and managing our property services
  • Client communication and service updates
  • Legal compliance and contract fulfillment
  • Marketing communications (with your consent, which can be withdrawn at any time)

8. Referral Program

Our referral program offers:

  • £250 for you when you successfully refer a friend who engages our Guaranteed Rent Service
  • £250 for your friend when they sign a Guaranteed Rent agreement

Referral payments are made once the referred client's service has been active for 30 days. Referrals must be made prior to the new client's initial contact with ND Real Estate.

9. Intellectual Property

All content on nikdhimal.com including text, images, logos, graphics, and software is the property of NIK DHIMAL LTD and protected by UK and international copyright laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Third-Party Services

We may refer you to third-party service providers including mortgage brokers, solicitors, surveyors, and insurance providers. These referrals are provided for your convenience. We do not guarantee the services of third parties and are not liable for their actions, omissions, or advice.

11. Governing Law & Disputes

These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from our services or these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11.1 Dispute Resolution

In the event of any dispute, we encourage you to first contact us directly at nik@nikdhimal.com to attempt an informal resolution. If informal resolution is unsuccessful, either party may pursue formal legal proceedings.

12. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Material changes will be communicated via email to active clients at least 30 days before taking effect. Your continued use of our services after changes become effective constitutes acceptance of the revised terms.

For existing Guaranteed Rent Service contracts, changes to terms will not affect your existing agreement unless mutually agreed in writing.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of law, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the original intent.
